1. Scope

These Terms and Conditions apply to all orders placed via our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business, or profession.

2. Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with Merch my Day GmbH.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You may place our products in your shopping cart without obligation and amend your entries at any time before submitting your binding order by using the correction tools provided for this purpose and explained in the ordering process. The contract is concluded when you accept the offer for the products in your shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

3. Contract Language, Storage of Contract Text

The language available for the conclusion of the contract is German.

We store the contract text and send you the order details and our Terms and Conditions in text form. You can view the contract text in your customer login area.

4. Delivery Conditions

Delivery Options
We deliver the products to the delivery address specified during the order process.

We only offer shipping. Collection of the goods in person is not possible.

5. Payment

5.1 Prices
The prices at the time of the order apply. These are total prices and include the applicable statutory VAT.

5.2 Payment Methods
The following payment methods are generally available in our shop:

PayPal
To pay the invoice amount via PayPal, you must be registered with PayPal, authenticate yourself with your login data, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after the order is placed. Further information will be provided during the order process.

PayPal may offer additional payment options to registered users based on its own criteria. We have no influence over the offering of such additional options. These are subject to your contractual relationship with PayPal. For more information, please consult your PayPal account.

Shop Pay / Shopify Payments
The payment transaction is executed upon completion of the order. Service provider: Shopify Inc., 151 O’Connor Street, Ottawa, ON K2P 2L8, Canada.

6. Retention of Title
The goods remain our property until full payment has been made.

7. Warranty and Guarantees

The statutory warranty rights apply.

7.2 Guarantees and Customer Service
Information on any additional warranties that may apply and their exact conditions can be found with the product and on special information pages in the online shop.

8. Liability

We are fully liable for claims based on damages caused by us, our legal representatives, or agents in the following cases:

injury to life, body, or health,
intentional or grossly negligent breach of duty,
guarantees, if agreed, or
where the scope of application of the Product Liability Act is applicable.

For breaches of essential contractual obligations due to slight negligence on our part, our legal representatives, or agents, liability is limited to the foreseeable damage typical for the contract. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract and on which the contractual partner regularly relies.

Otherwise, claims for damages are excluded.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), available here: https://ec.europa.eu/consumers/odr/.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

If individual clauses of these Terms and Conditions are wholly or partially invalid, the remainder of the contract remains unaffected. In such cases, the statutory provisions shall apply.
